A-223, Endowment or Restricted Gift Fund

Purpose
An A-223 is used to establish a new endowment, restricted gift, loan or plant
fund resulting from a gift to the University or the UC Foundation. A fund must
be established if a gift is received with restrictions that are different than
the restrictions of funds currently on the University’s books. A-223
processing requires a written document, signed by the donor, setting forth the
gift intent. (Note if the revenue is being received from a foreign source please
indicate this on the form.
Procedures
UC Foundation initiates this form. The terms, purpose, and restrictions
should reflect the exact quotation from the will or gift instrument that
provides the information. All supporting documents such as wills and letters
which identify restrictions or purpose of the fund will be attached to this form
and are retained with the Treasurer’s Office copy.
The University will not accept gift restrictions which are religious or which
favor non-minority racial groups. If restrictions of race or gender are
requested, there should also be language which would allow the University to
administer the gift should these restrictions be legally void. The language
should be similar to the following:
Should it become impossible for the University to restrict the use of this
gift as directed for (specify restriction), donor directs that the unused
portion of the gift be (specify action).
For approval and review, route the form intact and in the following sequence:

of Administrative office
- Vice
President
- Office
of the General Counsel
- Treasurer’s
Office
The Office of the General Counsel reviews to insure that any restrictions on
the A-223 agree with those stated in the correspondence/documents. The Office of
the Treasurer assigns a fund number and retains the supporting document.
Once a gift is made and an appropriate fund is established, a donor cannot
add new restrictions or conditions regarding that gift. However, a donor may
release restrictions, in writing, in which case a revised A-223 form would be
processed.
